(BRAZIL.) Pair of Portuguese edicts proclaiming rights for Indians in Brazil. Each 11 x 7½ inches, disbound, tipped into modern wrappers, minor worming. Lisbon, 1755 and 1758

  • Notes: 2 pages, lone wormhole, inked page number in upper margin. A royal decree that the descendants of Portuguese settlers and indigenous peoples would be "capable of any employment, honor, or dignity, without needing any dispensation." The caption summary on the second page reads "Alvará de Ley, porque V. Magestade he servido declarar, que os Vassallos deste Reino, e da America, que casarem com Indias della, naõ ficaõ com infamia alguma, antes se faraõ dignos da Sua Real attençaõ, e seraõ preferidos nas terras, em que se estabelecerem, para os lugares, e occupaçoens, que couberem na graduaçaõ de suas pessoas ; e seus filhos, e descendentes seráõ habeis, e capazes de qualquer emprego, houra, ou Dignidade, sem que necessitem de dispensa alguma, em razaõ destas alianças, em que se comprehendem as que ja se achaõ feitas antes desta Resoluçaõ ; e que o mesmo se praticará com as Portuguezas, que casarem com Indios, e a seus filhos, e descendentes, como assima se declara." A royal decree extending the rights of indigenous peoples in Maranhão "to the Indians who live throughout the continent of Brazil, without restriction, interpretation, or any modification." The caption summary reads: "Alvará com força de Lei, por que Vossa Magestade he servido ordenar, que a liberdade, que havia concedido aos indios do Maranhão para as suas pessoas, bens, e commercio, pelos Alvarás de seis, e sete de junho de mil setecentos cincoenta e cinco, se estenda na mesma fórma aos indios, que habitão em todo o continente do Brasil, sem restricçaõ, interpretaçaõ, ou modificaçaõ alguma, na fórma, que nelle se declara." Belem [Lisbon], 9 May 1758.
