The "grandfather" clause was a device employed in many Southern states to deprive Blacks of their voting rights. The act stated that no person be allowed to vote unless he be able to read and write any section of the state constitution. The act exempted those who were voting before 01 January 1866, which effectively enfranchised whites but excluded Blacks. The case was won in Oklahoma and then appealed to the Supreme Court which upheld the decision. The decision was repeatedly attacked and challenged until the acts of 1957 and 1964.
