"NOT TO BE SOLD OUTSIDE OF FAMILY" (SLAVERY AND ABOLITION-COLONIAL CONNECTICUT.) Manuscript Document Signed. Large folio sheet, folded to form four pages, written on the first and docketed on the fourth; with sealing wax seal; signed and dated by Esther Smith and witnesses. Middletown, CT, 1738-1739

  • Notes: a very early and uncommon connecticut slave document, wherein Esther Smith the widow of Rev. Joseph Smith transfers interest in her late husband's estate to her son Ensign Joseph Smith: "Ye Estate of my late Husband. . .both Real & personal. . .Cloys a negro man which belonged to my Husband. . .as also all my wearing Cloaths, Mony, Goods or Chattels; Cattle, Sheep, & Swine." Reverend Smith graduated from Harvard in 1695, and preached in Hadley, Springfield and Brookfield Mass, Cohanzy, New Jersey and Greenwich, Connecticut, before settling in Middletown. In a 1768 will, the younger Smith left his "Negro Man Cloip (sic) or Peter" equally to his five sons, with the stipulation that he "not be sold out of family unless of his own accord, and that he be provided for when infirm." Cloys is mentioned in other sources as "Cleops, Cloip, or Peter."
