  • Notes: The printed brief for New York State''s argument in the Lemmon v. New York. The Lemmons were a Virginia family traveling via New York to Texas with eight slaves in 1852. While they were in New York, an African American named Louis Napoleon noticed the slaves and secured a writ of habeas corpus on their behalf, and a judge released the slaves. The Lemmons appealed the case to the New York Supreme Court (1857) and the New York Court of Appeals (1860), but the decision was upheld both times. The next step would have been the United States Supreme Court, but secession put an end to any further appeal. See Paul Finkelman, Slavery in the Courtroom, pages 54-56. One copy in OCLC, and none traced at auction.
